​Child Consent, Authorisation and Release

Good Health Radio is committed to the protection of children, their interests and wellbeing. A number of initiatives supported by Good Health Radio provide the opportunity for young people to publicly express their views, ask and answer questions, and provide their perspectives on a range of issues impacting, and of interest to them. To ​promote the safety and wellbeing, and provide clarity around expectations of underage people involved with Good Health Radio, the following Child Consent, Authorisation and Release form must be read, understood and agreed to by a legal guardian of any person under the age of 18 who is to have any involvement with Good Health Radio.

To maintain the quality of content provided by Good Health Radio, a standard Interview Authorisation and Release is required to be completed by any person being interviewed, including children. This assists to protect the child ensure that all content is legally obtained through an appropriate process and used in accordance with our Charter and Code of Practice. 

The Child Consent, Authorisation and Release​ has been sourced through the Arts Law Centre of Australia.

    Terms and conditions
    this is a deed of release between
    The Parent or Guardian
    of 
    The Child
    and
    The Interviewer
    the parties agree as follows:

    1.   Interview
    1.1   The Parent or Guardian grants the Interviewer the right to make:
    1.1.1   audio and/or audio visual recordings (Recording) of the interviews (Interview); and
    1.1.2   notes and/or transcripts of the Recording (Transcript)
    for the purpose of the production specified in Schedule 1 (Production)
    1.2   To the extent that the Parent or Guardian or Child has moral rights in the Interview and the Recording or the Transcript (Material), the Parent or Guardian consents to any act or omission of the Interviewer (whether before or after this consent) in relation to the Interview, the Material which would, but for this consent, be an infringement of the Parent or Guardian’s or Childs moral rights which may be reasonably necessary.
    1.3   The Parent or Guardian and Child assigns any copyright in the Interview to the Interviewer and agrees that the Interviewer owns copyright in the Material.
    1.4   The Interviewer agrees to credit the Interviewee in the manner specified in Schedule 1 (Credit).

    2.   Risk Exposure Provision
    2.1   Unless otherwise stated, all Productions involving children will be pre-recorded, enabling post recording editing to ensure the final Production appropriately represents the Child in a positive manner.
    2.2  The Child may be:
    2.2.3   interviewed by or speak with persons whom:
    2.2.3.1   are not medical professionals
    2.2.3.2   have not received specific training in working with children
    2.2.3.3   are underage / a minor / a child
    2.2.3.4   are not aware of issues relating to your child’s condition, experiences, history or needs
    2.2.4   asked personal questions
    2.2.5   interviewed by another child
    2.2.6   left unsupervised by the Interviewer
    2.3   other unspecified risks


    3.   Interviewer’s rights
    3.1   The Interviewer may use and authorise others to use and exploit all rights in the Material in any and all media throughout the world (including any online media) for any purpose, in perpetuity as part of the Production or otherwise.
    3.2   The Interviewer may use, disclose, and authorise others to use and disclose the Parent or Guardian and Child’s name, photograph, likeness, voice, performance and biographical material in connection with the Production.

    4.   Child's Rights
    4.1   The Child is not under any obligation to answer any questions or be involved in any way with The Interviewer and may request (and be immediately granted) at any time to be released from any specific or all involvement with The Interviewer.
    4.2   On request, the Parent or Guardian will be granted final cut privilege of the Material involving the Child. 
    4.3   On request, Material involving the Child will be removed as quickly as practical from Production.

    5.   Parent or Guardian Responsibilities
    5.1   It is the expressed responsibility of the Parent or Guardian to:
    5.1.1   
    actively supervise and support the Child at all times while involved in the Interview and any associated activities
    5.1.2   seek clarification and inform the Interviewer in relation to any potential risks or triggers
    5.1.3   protect the Child from harm

    6.   Representations, warranties and indemnity
    6.1   The Parent or Guardian represents and warrants that there are no restrictions that prevent the Parent or Guardian from granting these rights. To the best of the Interviewee’s knowledge the information provided in the Interview is true, is not defamatory and does not infringe the rights of any third party. The Parent or Guardian indemnifies the Interviewer and agrees to hold the Interviewer (and the Interviewer’s licensees and assigns) harmless against any claims arising from a breach of this warranty and the exercise of the rights granted by the Parent or Guardian herein.
    6.2   The Parent or Guardian accepts the inherent risk of the interview on behalf of the Child and possibility of injury or loss resulting there from. I acknowledge that whilst the Interviewer will make reasonable effort to minimise exposure, not all dangers associated with this activity can be eliminated.
